Terms of Service
Effective Date: March 31, 2026
These Terms of Service ("Terms") constitute a legally binding agreement between you and AllGiggs, Inc. ("AllGiggs," "we," "us," or "our") governing your access to and use of the AllGiggs mobile application and website (the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms in their entirety. If you do not agree, do not use the Platform.
1. Eligibility
1.1 Customers: Must be at least 18 years of age and legally capable of entering into binding contracts. All customers must complete identity verification (government-issued photo ID + selfie match) before posting gigs or interacting with minors on the Platform.
1.2 Giggers: Must be between the ages of 8 and 18. All gigger accounts require a linked and verified parent or legal guardian account before any marketplace activity can occur.
1.3 Parents/Guardians: Must be at least 18 years of age, must be the legal parent or guardian of the linked minor, and must provide verifiable consent for their child's participation on the Platform.
1.4 Minor's Contract Capacity: Giggers under 18 lack independent legal capacity to enter into binding contracts. This Agreement is entered into between AllGiggs and the parent/legal guardian on the minor's behalf. The parent/guardian is the contracting party, the proper claimant in any dispute, and accepts all obligations and liabilities described herein as if they are the direct user. The minor cannot sue or be sued individually; any legal action must be brought by the parent/guardian as the child's legal representative.
1.5 You represent and warrant that all information you provide during registration and use of the Platform is truthful, accurate, and complete.
2. Nature of the Platform
2.1 AllGiggs is a marketplace platform only. We provide technology that connects customers who need help with neighborhood tasks to young people who wish to perform those tasks. AllGiggs does not employ, supervise, direct, or control any gigger. Giggers are independent individuals, not employees, agents, or contractors of AllGiggs.
2.2 Independent Worker Status & No Benefits: Giggers are NOT employees of AllGiggs or any customer. Giggers are not entitled to workers' compensation insurance, unemployment insurance, disability benefits, health insurance, paid leave, minimum wage protections, overtime, or any other statutory employee benefit. Parents assume full responsibility for obtaining private insurance coverage for gig-related injuries. AllGiggs does not withhold taxes, issue W-2 forms, or fund any benefit program. Parents and giggers are solely responsible for all tax reporting and payment obligations on earnings.
2.3 Background Verification Limitations: IMPORTANT: AllGiggs verifies customer identity through government-issued photo ID and facial recognition selfie matching. This verification does NOT: (a) screen for criminal history or sex offender status; (b) conduct background checks of any kind; (c) verify employment, income, or references; (d) guarantee the person is who they claim to be. ID verification has inherent limitations and does not eliminate risk. Parents must conduct their own due diligence, including independent research, before allowing their child to work at any customer's location.
2.4 AllGiggs does not guarantee the quality, safety, timeliness, or completion of any gig. AllGiggs does not verify the skills, qualifications, or background of giggers beyond the age-tier and parent verification systems described herein.
2.5 AllGiggs does not guarantee the identity, creditworthiness, or intentions of any customer beyond the authentication methods provided.
3. Fees & Payments
3.1 Platform Fee: AllGiggs charges a 10% platform fee on every completed gig, deducted from the gigger's earnings. The customer pays exactly the posted gig rate with no additional fees.
3.2 Payment Processing: All electronic payments are processed by Stripe, Inc., a PCI-DSS Level 1 certified payment processor. AllGiggs is not responsible for Stripe's availability, fees, or errors.
3.3 Cash Payments: For gigs designated as cash payment, the customer pays the gigger the full posted budget directly in person. The 10% platform fee is charged to the parent's saved Stripe payment method upon job completion. AllGiggs is not responsible for disputes, shortages, or failures in cash transactions.
3.4 Refunds & Payment Disputes: Refund requests must be submitted within 14 days of gig completion to hello@allgiggs.com. AllGiggs will investigate disputes within 5 business days. Grounds for refund may include: gig not completed as described, payment processing error, or technical failure by AllGiggs. AllGiggs may refund all or part of fees at its sole discretion. For Stripe-processed disputes, Stripe's own chargeback rules apply. For cash gigs, payment disputes must be resolved directly between customer and gigger; AllGiggs may investigate if fraudulent conduct is suspected but is not obligated to mediate.
3.5 Third-Party Payment Processing: All electronic payments are processed exclusively by Stripe, Inc. AllGiggs does not process, store, or have access to full payment card data. Stripe may refuse to process transactions, freeze accounts, or terminate service at Stripe's sole discretion. AllGiggs is not liable for Stripe service interruptions, payment failures, processing delays, chargebacks, or disputes. Payout timing depends on Stripe's settlement schedule (typically 2–5 business days).
3.6 Taxes: Users are solely responsible for determining and paying any applicable taxes on income earned or payments made through the Platform. AllGiggs does not provide tax advice, withhold taxes, issue 1099 forms, or assume responsibility for users' tax obligations.
4. User Conduct
You agree not to:
- Use the Platform for any illegal, harmful, or fraudulent purpose.
- Harass, threaten, abuse, or discriminate against any other user.
- Post false, misleading, or defamatory content, including fake reviews.
- Attempt to contact minors outside of the Platform's messaging system.
- Circumvent the Platform's safety features, payment system, or fee structure.
- Create multiple accounts, impersonate another person, or misrepresent your age.
- Use automated bots, scrapers, or other unauthorized means to access the Platform.
- Solicit users to transact outside the Platform to avoid service fees.
Violation of these rules may result in immediate account suspension or permanent ban, at our sole discretion, without notice or refund.
5. Safety, Assumption of Risk & Parental Responsibility
5.1 While AllGiggs provides safety tools (identity verification, parent verification, age tiers, pre-job phone calls, message monitoring, location alerts), you acknowledge and agree that AllGiggs cannot guarantee the safety of any in-person interaction between users. AllGiggs is not in loco parentis and does not supervise gigs.
5.2 ASSUMPTION OF RISK: Parents/guardians fully acknowledge and assume all risk of personal injury, death, bodily harm, property damage, illness, or economic loss arising from the child's participation in gig work, including but not limited to: cuts, muscle strain, allergic reactions to animals or chemicals, falls, weather-related hazards, motor vehicle accidents while traveling to/from gigs, interactions with unfamiliar third parties, and equipment-related injuries. Parents waive any claim against AllGiggs arising from such risks.
5.3 Parental Responsibility: For giggers under 18, the parent/legal guardian assumes full legal responsibility for: (a) supervising the child's use of the Platform and approving gigs appropriate for the child's age and abilities; (b) ensuring the child does not accept jobs that are illegal, unsafe, or beyond their capability; (c) providing proper training, safety equipment, and insurance for gig work; (d) complying with all applicable child labor laws, school attendance laws, and local ordinances; (e) any injury, property damage, or harm caused by the child during a gig; (f) maintaining emergency contact with the child during all gigs; (g) all tax reporting and payment obligations on the child's earnings. Parents who allow children ages 8–10 to perform gigs should strongly consider accompanying the child. Parent waives any claim against AllGiggs for harm arising from the parent's own negligence in allowing or supervising the child's participation.
5.4 Customer Obligations: Customers acknowledge that giggers are minors and agree to provide a safe, appropriate, and harassment-free work environment. Customers must not ask giggers to perform tasks that are dangerous, illegal, involve hazardous chemicals, require operating motorized equipment, or are inappropriate for the gigger's age tier. Customers must not be under the influence of drugs or alcohol when interacting with giggers.
5.5 Injury & Emergency Protocol: In the event of injury during a gig, the gigger or parent must: (1) contact emergency services if serious (911); (2) notify the customer; (3) document the injury with photos; (4) report to AllGiggs within 24 hours via hello@allgiggs.com. AllGiggs will log the incident but assumes no liability for medical costs, ongoing treatment, or lost earnings. Parents are solely responsible for obtaining medical care and pursuing claims against responsible third parties (e.g., customer's homeowner's insurance).
5.6 Communication Safety: All communication between customers and giggers must occur through AllGiggs' in-app messaging system. Customers may not request contact via phone, email, social media, or any off-platform channel. Giggers are instructed to decline and report such requests. Customers who request off-platform contact face account suspension or permanent ban. Communications within the app may be reviewed by AllGiggs and are visible to the linked parent/guardian.
6. Limitation of Liability
6.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALLGIGGS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform, any gig performed or received through the Platform, or any interaction with another user, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if AllGiggs has been advised of the possibility of such damages.
6.2 ALLGIGGS'S TOTAL CUMULATIVE LIABILITY to you for all claims arising from or related to the Platform shall not exceed the greater of (a) the total service fees paid by you to AllGiggs in the 12 months preceding the claim, or (b) one hundred dollars ($100).
6.3 AllGiggs is not liable for: (a) any injury, property damage, or loss arising from a gig; (b) disputes between customers and giggers; (c) the actions, omissions, or conduct of any user; (d) inaccurate information provided by users; (e) failure of third-party services (Stripe, Firebase, Apple, Google); (f) unauthorized access to your account resulting from your failure to maintain password security.
7. Indemnification
You agree to indemnify, defend, and hold harmless AllGiggs, its officers, directors, employees, agents, and affiliates from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any law or regulation; (d) any gig you post, perform, or participate in; (e) any dispute between you and another user; or (f) your negligence or willful misconduct.
8. Intellectual Property
8.1 The AllGiggs platform, including all software, graphics, designs, trademarks, service marks, and trade secrets, are exclusively owned by AllGiggs, Inc. and protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, transmit, modify, create derivative works from, or reverse engineer any AllGiggs intellectual property without prior written consent.
8.2 You agree not to: (a) scrape, crawl, or use bots to harvest content from the Platform; (b) decompile, disassemble, or reverse engineer the application; (c) use AllGiggs marks in any way that creates confusion or dilutes the brand; or (d) circumvent any technical protection measures.
8.3 User-generated content (reviews, messages, bios, photos) remains your property, but you grant AllGiggs a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, display, reproduce, modify, and sublicense such content in connection with the Platform. AllGiggs does not guarantee preservation of user content and may remove content at any time without liability.
9. Dispute Resolution & Arbitration
9.1 Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
9.2 CLASS ACTION WAIVER: You agree that any arbitration or proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against AllGiggs.
9.3 The arbitration shall take place in Santa Clara County, California (or remotely at either party's option), unless otherwise agreed by the parties. AllGiggs shall pay all AAA filing fees and arbitrator fees that exceed what would be owed in court. Both parties retain the right to appear pro se (without an attorney). The arbitrator's decision shall be final and binding.
9.4 Small Claims Exception: Either party may bring an individual claim in small claims court if the claim does not exceed the jurisdictional limit (currently $10,000 in California). For minors, the parent/guardian is the proper claimant.
9.5 Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property, unauthorized access, or imminent child safety concerns.
10. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. AllGiggs disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. AllGiggs does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
11. Termination
AllGiggs may suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections 6 (Limitation of Liability), 7 (Indemnification), 9 (Dispute Resolution), and 10 (Disclaimer) survive termination.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. To the extent any provision of these Terms is prohibited by California law (including limitations of liability for fraud, willful misconduct, or gross negligence), such provision is modified to the maximum extent permitted by law.
13. Force Majeure
AllGiggs shall not be liable for failure to perform any obligation hereunder if such failure results from causes beyond reasonable control, including but not limited to acts of God, war, terrorism, epidemics, pandemics, government actions, natural disasters, civil unrest, telecommunication failures, power outages, Internet service disruptions, or third-party service failures (including Stripe, Firebase, and Apple). Performance obligations shall be suspended during any such event.
14. Platform Availability
AllGiggs makes no guarantee regarding Platform uptime or continuous availability. The Platform may be unavailable due to scheduled maintenance, emergency repairs, or circumstances beyond AllGiggs' control. AllGiggs is not liable for: (a) inability to access the Platform; (b) gig cancellations due to app unavailability; (c) lost earnings due to system downtime; or (d) payment failures due to server or network errors.
15. Mandatory Reporting
AllGiggs is a mandated reporter under California Penal Code § 11165.7. If AllGiggs personnel become aware of suspected child abuse, neglect, sexual abuse, or exploitation involving any user, AllGiggs shall report such conduct to local law enforcement, the California Department of Social Services, or the National Child Abuse Hotline (1-800-4-A-CHILD) without delay. Reports may be made without notifying the user. You consent to such mandatory reporting as a condition of using the Platform.
16. Content Moderation & Safety Enforcement
AllGiggs employs automated and human moderation to detect violations of these Terms. Reported content will be investigated within 5 business days. Users may appeal account suspensions by submitting a written appeal to legal@allgiggs.com within 30 days. AllGiggs will review appeals within 10 business days. AllGiggs has zero tolerance for any conduct that sexualizes minors, includes grooming, solicitation of explicit content, or endangers child safety in any way. Such violations result in immediate permanent ban and referral to law enforcement.
17. Amendments & Modifications
AllGiggs may modify these Terms at any time by posting an updated version on the Platform. For material changes to liability limitations, dispute resolution, payment terms, or child privacy protections, AllGiggs shall provide 30 days' notice via email or in-app notification. Non-material clarifications may be updated without notice. Continued access to the Platform after notification constitutes acceptance of the modified Terms. If you do not agree, you must discontinue use and request account deletion. Material amendments to child privacy protections shall not take effect for users under 13 without renewed parental consent.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy, COPPA Compliance Policy, and Parent Guide, constitute the entire agreement between you and AllGiggs and supersede all prior agreements, understandings, and representations.
